Quick answer: if you lived in the UAE on your husband’s residence visa and you are now widowed or divorced, UAE rules allow you to stay without a new sponsor. Losing a husband or going through a divorce is hard enough. Worrying about your visa at the same time makes it harder. This guide explains, in plain steps, what the official rules say, what you need to prepare, and where to apply, so you can make decisions calmly and on time.
Who can stay in the UAE without a sponsor after divorce or death?
Direct answer: a foreign wife and her children who were sponsored by the husband, whose visas were valid at the time of the death or divorce.
The official UAE government portal (u.ae, page last updated 28 September 2026) says that when a woman living in the UAE on her husband’s visa is divorced or widowed, she is granted a one-year extension on her residence visa, starting from the date of the death or divorce, and that it does not require a substitute sponsor.
The main conditions are:
- You were on your husband’s residence visa.
- Your visa, and your children’s visas, were valid on the date of the death or divorce.
- You are inside the UAE when you apply.
- You can show suitable housing.
- You can show that you are able to support yourself financially.
You do not need to have children to qualify. A widow or divorcee without children can also apply, subject to the conditions explained below.
What changed in September 2025?
Direct answer: ICP updated the humanitarian residence conditions, set a six-month application window, and separated the rules for wives of UAE citizens and wives of foreign residents.
On Monday 29 September 2025, ICP announced a package of visa changes, including updated conditions for the residence of a foreign widow or divorcee without a sponsor. The key points ICP published are:

About the two descriptions: u.ae still describes the older wording, a one-year extension that is renewable one time only. ICP’s 2025 update says the residence may be extended for an equivalent period where valid reasons exist, and GDRFA Dubai says renewal for the children goes to the competent committee. In practice, plan for one year, and treat any second year as something you must apply for and justify. If your situation is unusual, ask ICP or GDRFA before you rely on a second renewal.
How long can you stay?
Direct answer: one year from the date of death or divorce, with a possible extension for the same period if the authority accepts your reasons.
GDRFA Dubai’s humanitarian cases service lists the residence permit as valid for one year and renewable, with renewal for the children of a widow or divorcee referred to the competent committee. Use that year well. It is meant to give you time to settle your children’s schooling, close your husband’s affairs, deal with loans or tenancy, and decide your long-term plan.
What about the children?
Direct answer: your children can stay with you if they were on their father’s visa at the time of the death or divorce, and their residence cannot run longer than yours.
Points to know:
- The u.ae portal says the extension applies to the woman’s children as well, provided they were on their father’s visa at the time of the death or divorce.
- The children’s residence period should not be longer than the mother’s.
- To sponsor the children yourself, you must be their legal custodian. If custody is disputed, the competent committee decides.
- For children aged 18 or over, a medical fitness test is required.

Documents you will need
Direct answer: the divorce or death certificate, proof of housing, proof of income or financial means, passports, and the previous residence details.
Prepare these before you start:
- Divorce certificate or death certificate. If the document was issued outside the UAE, it must be properly attested and legally translated.
- Proof of housing. An attested tenancy contract, or proof that you own the home. In Dubai, the tenancy is usually registered on Ejari (see our Ejari registration guide).
- Proof of financial means. A salary certificate or employment contract if you work, and bank statements. GDRFA Dubai lists bank statements for the last three months among its general documents.
- Passports for you and each child.
- Copy of the previous residence permit under your late or former husband.
- Recent passport photos with a white background.
- Birth certificates for the children, attested where required.

- Custody proof if you are sponsoring the children and custody has been decided by a court.

Government fees
Direct answer: in Dubai, GDRFA’s humanitarian cases service currently lists the fees below. Fees can change, so confirm them on the GDRFA page or app when you apply.

GDRFA also notes that the issuance fee rises by AED 100 each year once residence passes two years. Medical test, Emirates ID, insurance and typing centre charges are separate. Outside Dubai, ICP sets its own fees, so verify the amount with ICP before you pay.
Where and how to apply
Direct answer: in Dubai, apply through GDRFA’s humanitarian cases service. In the other emirates, apply through ICP.
In Dubai (GDRFA):
- Use the GDRFA website or smart app, signing in with UAE PASS, or visit an Amer service centre. GDRFA also lists its Humanitarian Cases Section at Festival Centre.
- Choose the humanitarian residence service and the category for divorced or widowed women and their children.
- Upload the documents listed above.
- Pay the fees.
- Wait for the committee review. GDRFA lists a processing time of 14 days, and each case is reviewed individually.
- After approval, complete the medical test where needed, Emirates ID biometrics and stamping steps.
In Abu Dhabi, Sharjah and the northern emirates (ICP):
- Use the ICP smart services website or the UAE ICP app, or visit a registered typing centre.
- Select the residence service for humanitarian cases, or ask the typing centre to select the right category for a widow or divorcee.
- Upload your documents and pay the fees.
- Follow up with the medical test and Emirates ID.

Do not miss the six-month window
Direct answer: apply as early as you can, and in any case within six months of the death or divorce.
The six months are counted from the date of the death or the date of the divorce, not from the date your old visa is cancelled. Some practical points:
- Start collecting documents straight away, especially attested certificates from abroad, which can take weeks.
- Keep your passport, Emirates ID and your children’s documents in one safe place.
- If your old visa is cancelled by the former sponsor, a grace period starts. Do not let it run out while you are still gathering papers.
Grace period: a separate rule
Direct answer: the grace period is the time you can stay after a residence permit is cancelled or expires. It is different from the one-year residence for widows and divorcees.
The u.ae portal says residents get flexible grace periods of up to six months, depending on their residence category. GDRFA Dubai’s humanitarian service page lists a 60-day grace period after expiry or cancellation of that permit. Overstaying after a grace period ends is fined at AED 50 per day, according to u.ae. What happens when the year ends?
Direct answer: you need a new long-term basis to stay, such as a job, your own business, a golden visa, or another family sponsor.
Your main options are:

If your late or former husband was an Emirati citizen
Direct answer: ICP’s 2025 update allows the foreign wife of a UAE citizen to be granted residence after death or divorce, and a widow or divorcee without children can apply within six months.
There are also separate long-standing rules for a foreign mother of UAE citizen children, who can be sponsored through her children. These cases often involve family book and custody details, so check your exact situation directly with ICP before you apply.

- Waiting for the old visa to expire before applying. The six-month window starts from the death or divorce.
- Applying without attested certificates from abroad, which leads to rejection or delay.
- Missing the custody document when sponsoring children.
- Leaving the UAE for a long period during the process. Long absences can affect residence status.
- Paying an agent who promises a “guaranteed” approval. Each case is reviewed by a committee.
